Our Legal Duty
The Health Insurance Portability & Accountability Act of 1996 ("HIPAA") is a federal program which requires that all health records about you are kept properly confidential.
This Act gives you, the patient, significant rights to understand and control how your health information is used. "HIPAA" provides penalties for organizations that misuse personal health information.
InterCare is fully committed to respecting and safeguarding your privacy at all times and pledges full compliance with all federal privacy requirements. All patients will receive a copy of their privacy rights when they become a patient at InterCare.
The Extent Required by Law
There may be certain times when InterCare must release your protected health information without your prior authorization. In this case, InterCare will use or disclose protected health information to the extent the use or disclosure is required by law and the use or disclosure complies with, and is limited to, the following:
- Court orders and court-ordered warrants
- Subpoenas or summons issued by a court, grand jury, governmental inspector general, or administrative body authorized to require the production of information
- A civil or an authorized investigative demand
- Medicare conditions of participation
- Statutes or regulations that require the production of information
Additional Requirements
InterCare will meet the additional requirements set forth in its policies and procedures governing the following described activities and purposes, if the disclosure:
- Is about victims of abuse, neglect or domestic violence;
- Relates to a judicial or administrative proceeding; or
- Is to law enforcement official for enforcement purposes?
